• Cannabis for private use is legal: The Constitutional Court ruled in Minister of Justice and Constitutional Development and Others v Prince (2018) that adults may cultivate and possess cannabis for personal use in private spaces.

• Selling cannabis is illegal: The sale, distribution, or public trading of cannabis remains a criminal offense under the Drugs and Drug Trafficking Act (140 of 1992).

• Cannabis clubs operate in a grey area: While some “private cannabis clubs” exist, their legality remains uncertain, and members risk legal consequences.
