The South African Department of Health has proposed new regulations under the Foodstuffs, Cosmetics, and Disinfectants Act (54/1972) that will prohibit the sale, importation, and manufacture of foodstuffs containing any part of the Cannabis Sativa L plant, including hemp, hemp seed oil, and hemp seed flour.
This means that hemp-based edibles—such as gummies, cookies, brownies, and infused snacks—could soon be illegal in South Africa. These regulations are still in draft form, but they signal a tightening of laws around cannabis-related products.

Many cannabis shops operating in Cape Town claim to be legal, but all storefront dispensaries selling cannabis products remain illegal under South African law. The only legal way to access cannabis is through private use and cultivation, as outlined in the 2018 Constitutional Court ruling.

• Cannabis for private use is legal: The Constitutional Court ruled in Minister of Justice and Constitutional Development and Others v Prince (2018) that adults may cultivate and possess cannabis for personal use in private spaces.
• Selling cannabis is illegal: The sale, distribution, or public trading of cannabis remains a criminal offense under the Drugs and Drug Trafficking Act (140 of 1992).
• Cannabis clubs operate in a grey area: While some “private cannabis clubs” exist, their legality remains uncertain, and members risk legal consequences.
